Filing of Official Form 101, Voluntary Petition for Individuals Filing for Bankruptcy - Effective December 15, 2017

On December 1, 2017, the Official Form 101, Voluntary Petition for Individuals Filing for Bankruptcy, Part 2, line 11, was amended to accurately reflect the requirements of § 362 (l) of the Bankruptcy Code.  All debtors against whom an eviction judgment has been entered with respect to their residence must fill out Official Form 101A (Initial Statement About an Eviction Judgment Against You), whether or not they desire to remain in their residence.  Form 101A is deemed to be part of the petition.  Effective December 15, 2017, the Official Form 101 Voluntary Petition must be filed on the new form with the revision date of 12/17 available on the U.S Courts' website, http://www.uscourts.gov/forms/individual-debtors/voluntary-petition-individuals-filing-bankruptcy.  Attorneys should contact their software vendors for more information.
